Terms of Service
Last updated October 15, 2026
Welcome to Kinly. These terms apply when you use our website, apps, phone calls and other services (together, the “Services”). Please read them. By creating an account or using the Services, you agree to them. If you don’t agree, please don’t use Kinly.
1. Who we are
Kinly (“Kinly,” “we,” “us”) provides an AI companion that calls older adults on the phone, keeps their families informed, and can arrange services for them. Our Privacy Policy explains how we handle personal information.
2. Accounts
- You must be at least 18 and able to form a binding contract to create an account.
- Give us accurate information and keep it up to date. You’re responsible for activity on your account, including by family members you invite. Keep access to your email secure, since we may sign you in with links sent there.
- If you give us a phone number, you agree that Kinly may call it, including with an AI voice, for the purposes you set up, such as introductions and urgent updates. You can ask us to stop at any time.
3. The people Kinly calls
When you sign up someone else to receive calls (the “Member”), you confirm that the number is theirs and that you have a good-faith reason to believe they would welcome the calls. The Member decides for themselves. We ask for their consent before calling regularly, and we stop calling if they tell us to. You can’t consent on their behalf.
The Member may choose what Kinly shares with you. Kinly may still tell you about things that affect their safety.
4. Using Kinly
You may not use the Services to:
- Call anyone who hasn’t agreed to be called, or who has asked us to stop.
- Deceive, harass, exploit, or financially take advantage of anyone.
- Get information about someone that they haven’t chosen to share.
- Break the law, or infringe anyone’s rights.
- Interfere with, reverse engineer, scrape, or gain unauthorized access to the Services.
5. What Kinly is not
Kinly is not an emergency service. It can’t send help. If you or the Member may be in danger, call 911.
Kinly is not a healthcare provider. It doesn’t give medical advice, diagnose, or monitor anyone’s health.
Kinly uses AI, and AI makes mistakes. Summaries, updates and other outputs may be incomplete or wrong, and calls may be missed or delayed. Don’t rely on the Services as your only way to check on someone.
6. If someone talks about ending their life
When someone talks about suicide or hurting themselves, Kinly follows a protocol: it does not encourage self-harm, and it refers them to crisis services, such as the 988 Suicide & Crisis Lifeline (call or text 988).
Kinly is not a crisis service. If someone may be in danger now, call 911.
7. Bookings and third-party services
Kinly can arrange services for the Member, such as rides, meals, prescription pickups and appointments, when the Member asks and has agreed to let Kinly act for them. We may do this by contacting a business directly or through a partner.
The businesses and people who provide these services (“Providers”) are independent of Kinly. Their own terms apply, and they’re responsible for what they provide. We don’t guarantee that any booking will be available, on time, or carried out as expected, but if something goes wrong, tell us and we’ll try to help.
You can set spending limits and approval rules for bookings. You authorize us to pay Providers on your behalf, within those rules, as described below.
8. Fees and payment
- Kinly doesn’t charge for its service. When we book something for you, you pay what the Provider charges.
- You authorize us and our payment processor to use the payment method you give us to pay these amounts, including taxes, tips and Provider charges such as cancellation fees.
- We may add paid features or change our fees. Before a change applies to you, we’ll let you know and give you a chance to review it.
- Fees are non-refundable except where we say otherwise or where the law requires it.
9. Your content
“Content” means what you and the Member give us or say to Kinly, and what the Services produce from it, such as call summaries. As between you and us, you keep any rights you have in your Content.
You give us a worldwide, royalty-free license to use, copy, store, process and create works from Content to provide, maintain, and improve the Services, including our AI systems, to keep people safe, and to comply with the law. We may also create de-identified or aggregated information from Content and use it for any lawful purpose.
If you send us feedback or suggestions, we may use them without restriction or payment to you.
10. Changes to Kinly
Kinly is new and will change. We may add, change, suspend or stop any part of the Services at any time. When a change significantly affects you, we’ll try to give you reasonable notice first.
11. Ending your use
You can stop the calls or close your account at any time. The Member can stop the calls at any time by telling Kinly. You still owe for bookings made before you stopped.
We may suspend or end your access if you break these terms, if it’s needed to protect the Member, you, others or Kinly, or if we stop offering the Services. Sections that by their nature should survive, like fees owed, disclaimers and limits of liability, will survive.
12. Disclaimers and limits of liability
The Services are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don’t promise the Services will be uninterrupted, error-free or secure, or that any call, alert or booking will happen.
To the fullest extent allowed by law, Kinly will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, or for the acts or omissions of any Provider. Our total liability for any claim relating to the Services will not exceed the greater of the amount you paid us in the six months before the claim arose, or $100.
Some states don’t allow some of these limits, so they may not all apply to you.
You agree to indemnify and hold Kinly harmless from claims arising out of your misuse of the Services or your breach of these terms, including signing up someone without a good reason to believe they’d want the calls.
13. Disputes
If you have a problem, please email hello@callkinly.com first. Most things can be sorted out that way.
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state or federal courts located in San Francisco County, California, and you and Kinly consent to their jurisdiction.
14. General
- We may update these terms. If a change is material, we’ll notify you, for example by email or in the app, before it takes effect. Continuing to use Kinly after that means you accept the updated terms.
- These terms, together with any terms shown to you for a specific feature, are the whole agreement between you and Kinly about the Services.
- If part of these terms can’t be enforced, the rest still applies. Not enforcing a term isn’t a waiver.
- You may not transfer these terms without our consent. We may transfer them, for example as part of a merger or acquisition.
